Consider the review of a premises licence following a Closure Order, under Section 80(5) Anti-Social Behaviour Crime & Policing Act 2014.

The Sub Committee considered the review of the premises licence in respect of the Waggon and Horses, 83 Lewisham Road, Smethwick, following a Closure Order issued by Dudley Magistrates Court on 11 August 2021, under Section 80 (5) of the Anti-Social Behaviour Crime and Policing Act 2014.

 

The premises had been identified as a nuisance to the public due to their poor structural condition following a survey under warrant powers on 22 July 2021. A risk of collapse had been identified causing a safety threat to those within and nearby the building.

 

The Closure Order was in force for a period of 3 months from the date of the order, until 12pm on 11 November 2021.

 

The Sub Committee heard that the applicant sought an adjournment on special grounds in order that a private structural engineer could access the premises and compile a report.

 

The Sub Committee was advised that it was reasonable for an adjournment to be considered.

 

The applicant’s representative argued that any adjournment would pose no risk the public as the Closure Order required the Premises to be closed for 3 months. 

 

Any adjournment it was argued would need to reflect that the meeting was being held at the behest of the magistrates and was bound by set deadlines. However, it was also necessary for the Committee to consider all relevant information.

 

The Sub Committee was minded to adjourn the matter to

8 September 2021.

 

 

Resolved that the meeting be adjourned to 8 September 2021, in order for the applicant to undertake an additional structural engineer survey.
